1. Broker status
Limitless Sky and Sea LLC ("Limitless Sky") acts solely as an air charter broker. We arrange transportation on behalf of clients with third-party licensed air carriers. We are not a direct air carrier and do not own or operate aircraft. The operating carrier is responsible for the actual air transportation and operational control.
2. Quotes and bookings
Quotes are indicative until aircraft availability is confirmed in writing by the operating carrier. A booking becomes binding when the charter agreement is countersigned and the agreed deposit or full payment is received.
3. Payment
Payment terms are specified in each charter agreement. Unless otherwise agreed, payment is due in full prior to departure. Accepted methods include bank transfer and major credit cards; card surcharges may apply.
4. Cancellation
Cancellation fees follow the operating carrier's policy and are stated in the charter agreement. Late cancellations may incur up to 100% of the charter price.
5. Operational changes
Flight schedules may be affected by weather, ATC, technical issues or other factors outside our control. The operating carrier has final authority over all safety-related decisions, including delays, diversions and cancellations.
6. Liability
Liability for the air transportation itself rests with the operating carrier under applicable international conventions (Montreal/Warsaw) and the carrier's own conditions of carriage. Limitless Sky's liability as broker is limited to the brokerage fee actually received for the affected flight, except in cases of intent or gross negligence.
7. Passenger obligations
Passengers are responsible for valid travel documents, visas and compliance with customs, immigration and health regulations. Dangerous goods, undeclared cash above regulatory thresholds and prohibited items may not be carried.
8. Governing law
These terms are governed by the laws of the Federal Republic of Germany. Exclusive place of jurisdiction is the registered seat of Limitless Sky and Sea LLC, to the extent legally permissible.
