How stand-alone charters stay outside Directive (EU) 2015/2302, and when an organiser addendum applies.

Stand-alone charter — outside the Package Travel Directive
Recital 15 of Directive (EU) 2015/2302 is explicit: a stand-alone travel service is neither a "package" nor a "linked travel arrangement". A pure single-entity charter sold by Limitless Sky to an EEA, Swiss, UK or Monaco customer therefore does not trigger the Directive's organiser obligations and is not covered by the Directive's insolvency-protection regime.
When the Directive does apply
If you ask us to combine the charter with at least one other travel service (hotel, yacht, vehicle rental, or another essential tourist service worth 25% or more of the total) and we agree, Limitless Sky takes on organiser status for that booking within the meaning of BGB §651a (Germany), Code du tourisme L.211-1 (France), the Italian Codice del Turismo, the Austrian Pauschalreisegesetz, or equivalent. We then:
- Issue the mandatory pre-contract standard information form (Annex I).
- Sign the Limitless Sky Organiser Addendum.
- Put in place the insolvency-protection mechanism required in the customer's country (bond, trust account or guarantee fund) and disclose it.
- Apply the cancellation, performance liability and refund regime of the national transposition.
French residents — financial guarantee
Non-EEA traders that direct activity at France (e.g., French-language pages, pricing in euros, French T&Cs) are required by the Code du tourisme to maintain a financial guarantee against insolvency, even without Atout France registration. Where this applies to a Limitless Sky booking, the guarantee details are disclosed in the cover sheet.
UK — ATOL whole-plane exemption
Where we sell the entire capacity of an aircraft to a single buyer for private, non-commercial purposes, the ATOL Regulations 2012 (Reg. 16) class exemption applies and ATOL protection does not apply to the sale (CAA ATOL 2022/02). We will tell you this in writing where the exemption is relied upon.
